Article I. Conditions of use of the site
This site is published by One Such, registered in the trade register under number 0725.967.695, whose registered office is located Rue Giller Galler, 10 in Liège. The Site is hosted by the company Creative Art, whose registered office is located at the following address: Rue Trappe 28 in 4000 Liège (tel: +32 4 94 70 43 33).
Below, the visitor will find the conditions of use of this site. The fact of accessing and browsing this site constitutes the visitor’s unreserved acceptance of the following conditions. These can be modified at any time. Modifications may be made at any time and come into force as soon as they are put online. It is therefore the responsibility of all visitors to read these conditions carefully before browsing the Site.
-The Site is the exclusive property of the company One Such. The company is the only one authorized to use and exploit the intellectual property rights, image rights and personality rights attached to this site, in particular trademarks, drawings and models.
It is forbidden to use all or part of the site, by downloading, reproduction, transmission or representation, except for personal and private use for non-commercial purposes.
-To create hypertext links to the site, it is necessary to obtain prior written authorization from One Such, which has the right to revoke it at any time.
-One Such reserves the right to correct the content of the site at any time and without notice. The company undertakes to update the information disseminated and to ensure its accuracy.
-Under the conditions provided for by law, One Such shall not be liable for any imprecision, inaccuracy, omission or for any damage resulting from a third party intrusion and concerning information made available on the site or access to the site.
-Access to the site may be interrupted at any time by One Such for reasons of maintenance, security or any other technical constraint.
Article II. General terms and conditions of sale
By agreeing to use our website, you acknowledge that you have read, understood and agree to be bound by these terms and conditions.
Section 2.1. Order procedure
The order of the articles can be made only via the website or our applications. On the site, the customer will find the description of the steps of the ordering procedure.
At the time of any purchase, an order form is filled out by the customer. Some fields of this document are mandatory to validate the order. Telecommunication costs (internet access and navigation) are at the customer’s expense. Before validating the order, the details of the selected items (price, size, name of the item) will be displayed so that the customer can modify any errors before confirming his purchase.
The price of the items and the delivery includes taxes unless otherwise stated in the details of the order. It is specified that the tax-free service is not available for distance purchases of One Such products. The cost of delivery of the items is borne by the customer.
The photographs, graphics and descriptions of the items offered on our platform are mentioned for information purposes only and are not binding on One Such. The customer service department undertakes to provide additional information for any request made by e-mail in compliance with the law and the conditions set out on our site.
If the connection is interrupted for a prolonged period of time, the selection of articles is not guaranteed. The order procedure will therefore have to be renewed. Once the customer has validated his order, One Such will acknowledge receipt of the order without delay and by electronic means. However, the sale will be taken into account once the order confirmation e-mail has been sent by One Such to the customer.
If the items requested are not available, One Such undertakes to send you a notification by mail and/or telephone and your order will be cancelled.
Any purchase made on our platform is reserved for private use and not for resale. For this reason, orders whose number of products and amount does not correspond to average usage will be refused by One Such. In addition, any order from a customer with whom there is a dispute regarding payment of a previous order will not be taken into account.
Section 2.2. Terms of Payment
The customer can pay for his purchases by credit card. The cards accepted are those of the CB, Visa, Eurocard/Mastercard, American Express networks and those issued on bank accounts domiciled within the European Union. The balance of the order is debited from the customer’s bank account once the preparation of the order has begun.
In the case of payment by bank transfer, the customer receives by e-mail the bank details enabling him/her to carry out the transaction.
If the balance due cannot be paid by the customer, One Such will cancel the order.
Section 2.3. Terms and Conditions of Delivery
The delivery of the articles is carried out once the payment of the balance has been registered in its entirety. One such delivers the goods to the address you have mentioned when you placed your order. The customer is responsible for the delivery costs. This amount is communicated to the customer beforehand during the validation stage of his order.
The delivery times, communicated by One Such, are only indicative. The signature is obligatory upon receipt. The customer is responsible for any problems that may arise. He or she has full ownership of the goods on the day of dispatch. In the event of non-delivery, the goods will be returned to us and the order will be cancelled. The refund will then be made. Upon receipt of the package, the customer will proceed to open it in case of external damage in order to check the good condition of the order. The customer will precisely detail any damage concerning the items received on the delivery note.
Section 2.4. Right of withdrawal: refund and exchange
In order to ensure customer satisfaction, One Such offers the possibility of withdrawing from the contract within fifteen days of receipt of the goods, without having to justify its decision or pay a penalty and under the conditions set out below. The customer notifies his decision to withdraw via the document provided for this purpose.
The right of retraction cannot be exercised for orders relating to items of a personalized nature by the customer or sealed goods, such as earrings, swimsuits, etc., which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection. Given the clearly personalized nature of the items, the items and/or made to order items cannot be the subject of either a refund or an exchange.
The return of articles
The customer can return his order by contacting customer service (info@onesuch.be) who will inform him of the procedure adapted to his request or by logging on to his account via which he can follow the return procedure.
The cost of returning the item will be borne by the customer if the customer chooses the postal return rather than the collection service. It will be up to the customer to keep the proof of this return, which implies that the items must be returned by registered mail. In all cases (refund or exchange), the customer must return the items delivered in their original packaging, complete (boxes, accessories, protections, labels, booklets, etc.) and accompanied by the return form duly completed.
Items returned incomplete, spoiled, damaged, deteriorated, soiled or in any other condition that would reasonably suggest that they have been used or worn, will not be refunded or exchanged and will be returned to him. Thus, the sole of the shoes must also be intact: as such, it is strongly recommended to try the sneakers on a surface such as a carpet or rug.
Refunds
The reimbursement of the sums paid for the returned item(s) will take place within fourteen days following the date on which the customer has notified One Such of his or her withdrawal or following receipt of the items by the company (if the customer chooses to return the items by post rather than using the collection service).
The refund will be made by crediting the customer’s bank account corresponding to the credit card used for payment or by transfer to the customer’s bank account. Furthermore, in the case of a gift, the right of withdrawal remains to the exclusive benefit of the customer and may not be exercised by the recipient of the gift.
Exchange
One Such offers its customers the possibility, via their customer account on the website onesuch.be, to exchange the items delivered within fifteen days of receipt. The customer may then return the articles concerned under the conditions referred to in the paragraph “the return of articles” above. The new order will comply with the general conditions of sale. One Such reserves the right to refuse an exchange beyond two successive requests. In addition, the delivery costs, paid by the customer during the first transaction, will not be reimbursed.
Section 2.5. Warranty conditions
The customer must ensure that the items delivered to him correspond to his order. In the event that the items delivered do not correspond to his order, the customer must inform One Such’s after-sales service by e-mail (info@onesuch.be) and must return the items in question under the conditions set forth above. The items delivered are subject to the warranty conditions provided for by law.
